What are Statutory Positions?

Under WHS regulations, mine operators must appoint appropriately qualified individuals to the statutory positions listed in Schedule 26 of the Work Health and Safety (Mines) Regulations 2022. For a full list of approved WHS risk management units for statutory positions, refer to the relevant government guidelines here.

Does Schedule 26 replace Section 44?

Yes. Schedule 26 under the WHS (Mines) Regulations 2022 has replaced Section 44 of the now-superseded Mines Safety and Inspection Act 1994.

What regulations do these courses align with?

Our statutory supervisor courses align with the Work Health and Safety (Mines) Regulations 2022 requirements outlined in Schedule 26 for statutory positions in mining operations.

How are the courses delivered?

Training is delivered face-to-face at our Victoria Park training centre. The assessment component is submitted online after the workshop. You will begin this during the face-to-face session.

What happens after I complete the training?

You will:
  1. Complete and submit the online assessment, which is marked by your course facilitator (trainer/assessor).
  2. Receive a Statement of Attainment for the completed Units of Competency.
  3. Be eligible to sit the DEMIRS legislation exam.
We recommend completing our DEMIRS Exam Preparation Course beforehand to maximise your chances of success.

What’s the deadline to comply?

Under the transitional provisions, a competent person may be appointed to a statutory supervisor position until 20 March 2026. Make sure you're trained, qualified, and compliant ahead of this deadline.
